As a valued customer of TuoBeyond, we would like you to be familiar with our trading terms, to ensure that your Tuobeyond experience is a satisfying one.

Your purchase of goods from www.tuobeyond.com (website) is subject to these Terms and Conditions of Sale & Promotion, Shipping & Return Policy, , Website Terms & Conditions of use, and the Privacy Policy  (collectively referred to here as “Terms”). If you do not accept these Terms, you must refrain from using this website or making a purchase from this website.

www.tuobeyond.com is a website operated by Fornile Sdn. Bhd. (“us”, “our”, “we”, “Supplier” “TuoBeyond”). We are a private limited liability company registered in Malaysia.

You and TuoBeyond may enter into a sale contract for the sale and supply of goods or services described in this website, by you making an offer to TuoBeyond via the website to purchase the goods and services at the specified price, subject to these Terms.

In these Terms:

  • “you”, “user”, “member”, and “guest” means anyone who visits and/or uses this website
  • reference to a “third party” in these Terms includes a reference to any agent or contractor of TuoBeyond, or of any of its related entities, and any person engaged by any of them, in the creation, provision or maintenance of the website or in the fulfilment of orders made through the website, and includes any of them
  • a reference to the “website” means tuobeyond.com
  • “Order” means an offer made by you in response to an invitation to treat made by TuoBeyond via the website.

We reserve the right to revise these Sales Terms from time to time at our discretion. Such revisions will be effective immediately upon publication on this website. We recommend you review the terms for amendments each time you use the website before placing any Order. By using this website after such publication, you agree to be bound by these Sales Terms as revised. Any changes to these Sales Terms will apply to any Order you place from the effective date of the change.

Guests & Registered Users

You may access and/or use the website as a guest or as a member.

 

To become a website member, you must provide your name and address, telephone number, a valid email address and nominate a password. If you do not provide accurate and complete details, we may not activate your membership or supply goods or services to you. You agree to keep your membership details current at all times by accessing your account via the website member login.

Placing An Order

To place an order, simply select the product(s) and/or Service(s) you’d like to purchase and add them to the cart. Then fill in your delivery details if you’ve never shopped with us before, and proceed to checkout.

We recommend you carefully preview any proposed Orders before adding them to your shopping cart and proceeding with your Order. Once you are making payment in full and an Order has been accepted by TuoBeyond, no cancellation of that Order is valid unless you receive our written communication permitting the cancelled Order.

TuoBeyond reserves the right to refuse to fulfil any purchase or orders from any resellers.

Make Payment

All prices listed on the website are in Malaysian Ringgit (MYR) and are inclusive of Service & Sales Tax (if applicable). 

Payment will be made online via iPay 88, a payment gateway that accepts credit cards, debit cards (Paypal), and local bank online transfers.

The following credit cards / payment method are accepted: VISA, MASTERCARD, PAYPAL, Maybank2u, CIMB Clicks, RHB Online, AM Bank, Alliance Online, Hong Leong Online, FPX (Bank Islam, CIMB Clicks, Maybank, Hong Leong Online, PBeBank), Bank Rakyat, Affin Bank.

To minimize the risk of unauthorized access, we encrypt all your card data.  All orders are subject to acceptance and product availability.

your Order Cancellation Rights

Order Of Product

If you change your mind before you have received your order, we can accept cancellations within 24 hours. If an order has already been dispatched, please refer to our refund policy.

Any cancellation comes after 24 hours and before our dispatch; there will be 3% administrative charges deducted from us before the refund.

Promotion & Sales

Discount Codes & Vouchers

Discount codes or vouchers offered at tuobeyond.com is valid for use on non discounted items only unless stated otherwise. It is solely at the discretion of the TuoBeyond team to adjust and change the mechanics of the discount codes or vouchers. Discount Codes are not stackable.

For Items On Clearance

All products on Clearance are either discontinued lines, ex-display items or come with slight imperfections/damage. Please note that there are no refunds/returns or warranty on these items, and they are sold As-Is.

Whilst we will endeavor to update stock levels, your item may be sold out, and we will issue a refund if your Order cannot be fulfilled.”

Pricing

Items in your Shopping Cart will always reflect the most recent prices displayed on the items’ product detail page and consider how you accessed the Site, the daily promotion and any applicable coupon code provided. Please note this price may differ from the prices shown for the items when you first placed them in your Shopping Cart. Placing an item in your Shopping Cart does not necessarily reserve the price shown at that time; most TuoBeyond discount offers are for a limited time only and have stated expiration dates.

Accordingly, an item’s price may change between the time you place it in your Shopping Cart and the time you complete your Checkout. In addition, prices are subject to the availability of the product at the time of ordering.

While TuoBeyond strives to provide accurate pricing information, pricing or typographical errors may occur. If an item is listed at an incorrect price due to an error in pricing, TuoBeyond shall have the right, at TuoBeyond’ sole discretion, to refuse or cancel any orders placed for that item. If an item is mispriced, TuoBeyond may, at TuoBeyond’ sole discretion, either contact you for instructions or cancel your Order and notify you of such cancellation.

Risk & Property

The Goods on the Order will be delivered to the address stipulated on the Order. The Supplier does not facilitate collections from its warehouse. Risk in the Goods shall pass to the Customer on completion of delivery. Title to the Goods shall not pass until the Supplier receives payment in full for the Goods. 

In the event of non-payment, the Supplier may recover or resell the Goods to discharge any overdue payment from the Customer.

Product Specification

The Supplier reserves the right to make changes in the Specification of the Goods which do not materially affect their quality or performance

The Customer should refrain from advising installers to prepare materials and installation without physical delivery and receipt of the goods. The Supplier will not be held responsible for costs in the event of any specification changes to its products. 

Any typographical, clerical or other error or omission in any sales or promotional literature, Quotation, website, price list, acceptance of offer or counter-offer shall be subject to correction. The Customer shall be notified of the changes thereafter. Suppose the Customer chooses to accept the notification or remain silence in the next 48 hours after the announcement. In that case, the Customer shall waive their right to claim for any breach arising thereof.

Indemnity

Excluding the extent to which the Supplier may be liable to the Customer under the Contract, the Customer agrees to indemnify the Supplier against all reasonable losses incurred by the Supplier.

Limited Liability

The Supplier shall not be liable for any indirect or consequential loss, howsoever caused, including loss of profits, pure economic loss, administrative inconvenience, loss of business, goodwill, contract, anticipated savings, delivery and assembly costs, installation or reinstallation costs, property or assets or liability under agreements with or to third parties resulting from such breach.

Force Majeure

Fornile will not be liable for any delay in performing any of their obligations if circumstances beyond their reasonable control cause such delay, including but not limited to failure of or interruption in the provision of essential services such as electricity supply, bank payment systems or postal deliveries.

Governing Law

The courts will have non-exclusive jurisdiction over any claim arising from or related to, a visit to our website or any Order placed on the website. However, we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These Terms are governed by Malaysian law.

Severability

If any part of these terms are found to be void, invalid, unlawful or unenforceable, then that provision or part will be deemed to be severed from these terms, and the remaining terms and provisions of these terms will remain in force and constitute the agreement between you and TuoBeyond.

Transfer & Assignment

If Fornile merges, sells or otherwise changes control of its business or this website to a third-party, Fornile reserves the right, without giving notice or seeking consent, to transfer or assign the personal information, content and rights that Fornile has collected from you and any agreements it has made with you.

Waiver

The failure by Fornile to exercise or enforce any right or provision under these terms will not constitute a waiver of such right or provision. Any waiver of any provision under these terms will only be effective if it is written and signed by Fornile.
